Bah, I’ve been robbed
Following the locking of the eBay Seller Central thread concerning the theft of an item of furniture :- I’ll continue to post updates here.

Hi all , could do with some advice, firstly I’d like to say that I’m not new to selling on eBay I’ve been selling on eBay for around 10 years but this is a first for me.
I sold two items of furniture, a table and a bench, on my personal account and both buyers arranged to collect them last Friday at different times from a storage facility where I’d kept them.
Buyer 1 – the bench, turned up an hour and a half late at 1pm which was the same time as buyer 2 – the table.
Buyer 1 inspects her item,l says how nice it is and I help her put it in her car. She says goodbye and goes to get in her car. At this point I remind her that she hasn’t paid. The item isn’t particularly expensive – £50
Buyer 1, at this point says she has paid, in-fact, she says, she paid through paypal within 5 minutes of winning the auction the night before and also sent me a message to inform me of this. I tell her she hasn’t paid, both items were listed
as payment on collection although I had checked that morning to make sure neither had ” in-advertantly ” paid via pay-pal, they hadn’t.
Buyer 1 starts to get shirty telling me there’s nothing she can do as she ” feels ” she’s paid. At this point the piece of furniture is in the boot of her car.
Buyer 2 ( a couple ) are listening to all this and it’s beginning to get awkward, I get the feeling that they think I’m trying to pull a fast one. I apologise to them and ask buyer 1 to give me a couple of minutes while I get the table for buyer 2.
I go back inside the storage facility, it takes me less than 2 minutes to get the table, I come back out and buyer 1 has driven off with the bench.
Buyer 2 ( the couple ) look at me open mouthed. They apologise and say ” We’re really sorry, she’s just stolen that hasn’t she ?, she said to us that she couldn’t wait all day and that she was leaving ” I assure them it wasn’t their
fault and explain to them that, in-fact she was an hour and a half late so waiting two more minutes wouldn’t have been so terrible.
Anyway, I give buyer 2 their table and they leave. I ring buyer 1 on her mobile and get her answerphone ( surprise ) so leave a message telling her to return my item. She calls back a couple of minutes later and tells me that
she ” feels ” as though she has paid therefore it isn’t theft ! I tell her it is theft and she can feel what she wants but unless I feel some money I’m calling the police. She hangs up.
I call several more times – no reply
So, feeling rather stupid I go home, log into paypal and, of course, no payment. To make doubly sure I ring eBay to check and they tell me no payment was ever initiated for this item. I ring Paypal who tell me that no payments are pending.
TBH I knew what the outcome of these two calls would be I just wanted to make sure I hadn’t missed something.
At this point, I apparantly made a mistake, I sent the buyer an invoice. I hadn’t sent one earlier, I’d used the contact buyer option to send the collection address and my tel number, the buyer had contacted me by text rather than messaging which didn’t seem unusual and has happened many times with collection items over the last 10 years.
I leave it a couple of hours, I tried to call a few more times and then I ring the police non-emergency number to report a theft. They are most sympathetic and tell me an officer will call the buyer to find out what is going on.
Later that evening a police officer rings me to tell me it isn’t a police matter it’s a civil debt, I point out that this woman has stolen my property without attempting to pay, he says ” listen buddy, you haven’t got a leg to stand on, you sent an invoice so you’ve agreed she has time to pay “
Apparantly, according to PC Dim, as soon as I ask her to pay it becomes a civil matter. I tell PC Dim I’m off down to Tesco in the morning for a new TV and when I get to the till and am asked to pay,I’ll just walk out with it and they can sue me for it as I won’t be breaking the law. He says ” that’s just hyperthetical “
So, I have the buyer’s name and address and tel number. The address checks out, she runs a business from there and it’s about 20 miles from me. I could go round there but I’m a big guy and no shrinking violet and I think if I do that I’ll be having my sunday lunch in the cop shop.
I also have 2 witnesses who will give evidence that she drove off with the item ( they emailed me later in the day to find out what happened and said they would ) I also have CCTV footage of her arriving, me loading the item into the car, and her driving off.
I’m left with one course of action I think, small claims, unless one of you guys can come up with a better idea. Also if anyone has a good letter before action I could borrow I’d appreciate it.
Apologies for the long rant I just wanted to get everything in.
My down-fall seems to have been turning my back on someone for 2 minutes. Very sad really

An epic thread which truly took me by surprise. I had a lot of helpful comments and the thread continued into the 14 day period after which I gave my buyer 14 days to pay in a Letter Before Action.
I am now almost at the stage of issuing an online money claim and will post updates.
